These terms
These terms are an agreement between you and Ellis, for the Ellis app and the website at www.askellis.care. By using either, you agree to them and to our Privacy Policy.
Ellis is run by Munzer Al Azzeh, an individual developer in the United States, who publishes the Ellis app on the App Store. No company has been formed yet, and when one is, it will be named here. On this page, “Ellis”, “we” and “us” mean the person who runs Ellis.
The app is licensed to you under Apple’s standard Licensed Application End User License Agreement. Where these terms say nothing about a matter, that agreement governs it.
What Ellis does
Ellis is an iPhone app for an adult who wants help with everyday things, and for the person who helps them. The Caregiver, the adult who holds the account, sets Ellis up for the person they look after, who talks to Ellis by voice in the app. Ellis uses AI to understand what is said and to answer. Ellis can:
- Ask a pharmacy, by telephone, for a refill of a medicine the Caregiver has added, and call the prescriber’s office if the pharmacy says a new prescription is needed.
- Book an appointment with a doctor the Caregiver has saved, or move one that is coming up, by telephone, when the Caregiver asks.
- Tell the Caregiver what happened on each call.
- Open the phone’s dialer when the person asks to ring someone they call.
- Remind the person the day before an appointment.
Apart from booking or moving an appointment the Caregiver asked for, Ellis never books, cancels, orders or pays for anything.
What Ellis is not
Ellis is not a medical device and not an emergency service. It does not call for help in an emergency, and it does not watch for one. If someone is in danger or unwell, call 911. For a mental health or suicide crisis, call or text 988.
Ellis does not give medical advice. It does not diagnose, prescribe or change a treatment, and nothing it says replaces a pharmacist or a doctor. Questions about medicines, doses or symptoms belong with them.
Ellis is not a pharmacy, a health plan or an insurer. It does not file insurance claims, and it cannot say what a plan covers.
Who can use Ellis
You must be 18 or over to create an Ellis account, and Ellis is set up only for an adult. Before setting it up, the Caregiver confirms in the app that they are 18 or over and that the person they look after knows about it. Do not set Ellis up for someone without their knowledge.
Your account and what you enter
The Caregiver is responsible for what is entered into Ellis and for keeping it accurate: names, dates of birth, addresses, phone numbers, medicines, prescription numbers, pharmacies, prescribers, appointments and insurance numbers. Ellis acts on what it has been told. A wrong phone number or an old prescription number means a wrong call, so check what Ellis fills in, especially anything read from a photograph.
Keep your sign-in secure. You are responsible for anyone you let use your account. If you think someone else has access to it, tell us at hello@askellis.care.
What you enter stays yours. You allow us to use it only to run Ellis for you: to store it, to show it in your household, to give it to a pharmacy or an office Ellis calls for you, and to keep the records described in our Privacy Policy.
The telephone calls Ellis makes
By adding a medicine, the Caregiver authorizes Ellis to call that medicine’s pharmacy and prescriber about it on the person’s behalf, and confirms that they are allowed to ask for this. Ellis calls when a refill is asked for, by the person or by the Caregiver. If the pharmacy says a new prescription is needed, Ellis calls the prescriber’s office, and if the office agrees, calls the pharmacy again. By asking Ellis to book or move an appointment with a doctor they have saved, the Caregiver authorizes Ellis to call that doctor’s office about it on the person’s behalf, and confirms that they are allowed to ask for this.
An AI voice agent speaks for Ellis on these calls. It says who it is calling for and why. Beyond that, it gives the pharmacy or office the person’s date of birth, address and phone number, the medicine and prescription details on file, and the appointment asked for, one at a time and only when it is asked. No audio of the calls is recorded or kept.
We cannot promise the outcome. A pharmacy may decline a refill or say it needs the doctor, a prescription may have no refills left, an office may have nothing at the time asked for, a line may be busy, or nobody may answer. Ellis reports what it was told; it does not decide these things and cannot override them. If Ellis cannot place a call, it tells the Caregiver, so the request is not lost.
Ellis never agrees to a payment or orders anything on a call, and apart from booking or moving an appointment the Caregiver asked for, it never books or cancels anything. Collecting and paying for a prescription, and anything an office asks to be paid, stays between the person and the pharmacy or office.
Subscriptions and billing
Ellis is a paid subscription sold through Apple’s App Store. There are two plans: Ellis Monthly, at $49.99 per month, and Ellis Yearly, at $419.99 per year. Apple may add sales tax where it applies.
- Payment is charged to your Apple ID account when you confirm the purchase.
- Your subscription renews automatically unless you cancel it at least 24 hours before the end of the current period.
- Your account is charged for the renewal within the 24 hours before the end of the current period, at the price of your plan.
- You manage and cancel your subscription in your App Store account settings: on your iPhone, open Settings, tap your name, then tap Subscriptions. In Ellis, tapping Manage subscription in Settings opens the same place. If you cancel, Ellis keeps working until the end of the period you have paid for.
- Deleting your Ellis account does not cancel an Apple subscription. Cancel the subscription as well, or it will keep renewing.
Refunds are handled by Apple, under Apple’s policies. You can ask Apple for one at reportaproblem.apple.com.
If the price of a plan changes, Apple tells you before the new price applies to you, and you can cancel before it does.
What we ask of you
Use Ellis only for the person it was set up for, and only with their knowledge. Do not enter details about anyone who does not know about it, or ask Ellis to call about a medicine that is not that person’s. Do not use Ellis to harass, deceive, impersonate or defraud anyone, including a pharmacy or a doctor’s office. Do not try to get around its limits, interfere with the service or anyone else’s use of it, or copy, reverse engineer or resell it.
Ending, and deleting your account
You can stop using Ellis at any time. The Caregiver can delete their account in Settings in the app, which deletes the household and everything in it. The person they look after can delete Ellis’s sign-in from their own phone, in their Settings. Delete your account explains both. The Caregiver can also remove Ellis from the other person’s phone at any time, in Settings.
We may suspend or end access to Ellis if you break these terms, if we must for legal or safety reasons, or if we stop offering Ellis. If we stop offering Ellis, we will tell you by email before it stops.
Changes to Ellis and to these terms
Ellis will change. We may add, change or remove features, and we may pause the service for maintenance or for safety.
We will update these terms when the service changes in ways that affect them. The date at the top is the date of the last change. If a change matters to you, such as a change to what Ellis does with your information or to what you pay, we will tell you by email or in the app before it takes effect. If you keep using Ellis after that, you accept the change; if you do not, stop using Ellis and delete your account.
Ownership
The Ellis name, mark, app and website, and their contents, belong to us. Using Ellis gives you the right to use the service as these terms allow, and no other rights in it. You are welcome to link to the guides on this website and to quote them with attribution.
What we do not promise
Ellis is provided as it is. We do not promise that it will always be available, that it will be free of mistakes, or that it will suit a particular purpose. AI can mishear and can be wrong, and speech recognition is wrong more often with quieter voices and less common accents. That is why Ellis asks for a clear yes before it acts on a request, and why the Caregiver can read what happened on each call.
To the extent the law allows, we are not liable for indirect, incidental, special or consequential loss arising from the use of Ellis, and our total liability to you for anything connected with Ellis is limited to the amount you paid for it in the twelve months before the claim, or one hundred US dollars if you paid nothing. Nothing in these terms limits liability that the law does not allow to be limited.
Apple
These terms are between you and us, not Apple. Apple is not responsible for Ellis or its content, and has no obligation to provide maintenance or support for it; for support, contact us. Apple is not responsible for addressing claims about Ellis, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection claims, or claims that it infringes someone else’s intellectual property. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
You confirm that you are not located in a country subject to a US government embargo, and that you are not on any US government list of prohibited or restricted parties.
Disagreements
If something goes wrong, tell us first and we will try to put it right. These terms are governed by the law of the State of California, without regard to its conflict-of-law rules. Any dispute that cannot be resolved between us will be brought in the state or federal courts located in San Francisco, California, and you and we each agree to that venue.
If any part of these terms turns out to be unenforceable, the rest still applies. These terms, the Privacy Policy and, where these terms are silent, Apple’s standard license agreement are the whole agreement between you and us about Ellis.
